Polar Air Cargo Worldwide, Inc. Media Release Form

I, [insert first and last name in form below], (the “Releasor”) hereby irrevocably grant worldwide, royalty-free permission and consent to Polar Air and its affiliates (“Polar Air”) to use, reproduce, publish and distribute, in any media now known or hereafter developed, for any and all purposes related to Polar Air businesses or related operations, the following photograph(s) or video(s) as described below (the “Photos/Videos”):

Copies of the Photos/Videos are attached to this Release or are being transmitted to Polar Air simultaneously with a copy of this Release properly executed by Releasor.

Releasor hereby releases Polar Air, its employees, contractors and any third parties involved with the creation or distribution of Polar Air promotional or marketing materials, from all liability in connection with usage of the Photos/Videos.  Releasor hereby acknowledges and agrees that he/she has granted Polar Air the foregoing permission to use the Photos/Videos without any expectation of receiving financial compensation of any kind from Polar Air or any other party.  In consideration for Releasor executing this Release, the Photos/Videos will become eligible to be used, reproduced, published and/or distributed by Polar Air in connection with conducting its business.  However, Releasor shall not be under any obligation to use or publish the Photos/Videos.  Polar Air shall not have any obligation to identify Releasor as the creator or owner of the Photos/Videos.  Releasor represents and warrants to Polar Air that Releasor is authorized to execute this Release, that Releasor owns all copyrights and/or other rights in and to the Photos/Videos, and that no other third party owns any rights in or to the Photos/Videos, and that usage of the Photos/Videos by Polar Air will not violate the rights of any third party, including, without limitation, any copyright rights, rights of publicity or privacy, or other similar rights.  Releasor shall indemnify and hold harmless Polar Air from and against claims, causes of actions, actions, damages, or losses asserted by any third party in connection with the Photos/Videos.  This Release shall be governed by the laws of the State of New York.  Any claim or controversy arising out of this Release shall be heard exclusively in the federal or state courts located in the State of New York, County of Westchester.  This Release may not be changed orally.

By signing his or her name in the space provided below, Releasor hereby agrees to the foregoing terms and conditions in connection with the Photos/Videos.
